Lancashire Parent Carer Forum and SEND Partnership Protocol

A statement of intent between Lancashire County Council, Lancashire Parent Carer Forum and NHS Lancashire and South Cumbria (ICB) to work collaboratively together.

This statement was approved between the parties on Thursday 11 January 2022 at the SEND Partnership Board.

Details

The protocol sets out how the parties will work collaboratively together under the umbrella of the SEND Partnership. It is not a contractual document and does not impose any legal obligation on any party.

This agreement recognises Lancashire Parent Carer Forum as the strategic partner for co-production of Lancashire County Council and NHS Lancashire and South Cumbria (ICB).

It seeks to ensure compliance with the statutory responsibilities of Lancashire County Council and NHS Lancashire and South Cumbria within:

  • 0-25 SEND Code of Practice, 3.31
  • Section 19 of Children and Families Act 2014
  • NHS Constitution - Strengthened by Health and Social Care Act 2012
  • Care Act 2014

The four cornerstones model

The protocol commits the SEND Partnership to use the Genuine Partnership model of co-production to audit and encourage service improvement.

Also known as the four cornerstones model, the cornerstones are:

  1. Welcome and care
  2. Value and include
  3. Communicate openly, clearly and honestly
  4. Work in partnership

The model was developed by Genuine Partnerships, an organisation from Rotherham including Rotherham Parent Carers Forum. 

It will be underpinned over coming years by continuous training and development as well as a presence in publications and the local offer.

We expect to develop a set of quality indicators on how the cornerstones of coproduction are working in practice. And to produce an Annual Report for the SEND Partnership Board.

Statutory responsibilities around co-production

SEND Code of Practice

“Local partners should identify the outcomes that matter to children and young people with SEN or disabilities to inform the planning and delivery of services and the monitoring of how well services have secured those outcomes."

Section 19 of Children and Families Act 2014

The Child and Family Act s19 states that local authorities must have regard to:
(a)the views, wishes and feelings of the child and his or her parent, or the young person.

(b)the importance of the child and his or her parent, or the young person, participating as fully as possible in decisions relating to the exercise of the function concerned.

(c)the importance of the child and his or her parent, or the young person, being provided with the information and support necessary to enable participation in those decisions.

(d)the need to support the child and his or her parent, or the young person, in order to facilitate the development of the child or young person and to help him or her achieve the best possible educational and other outcomes.

NHS Constitution - Strengthened by Health and Social Care Act 2012

‘NHS England will ensure that public, patient and carer voices are at the centre of our healthcare services, from planning to delivery. Every level of our commissioning system will be informed by insightful methods of listening to those who use and care about our services’.

Health and Social Care Act 2012:

  • Duty to ‘promote involvement of each patient’ and ‘duty to involve’.
  • Duty as to patient choice
  • Public participation duties on CCGs and NHS England
  • Duty to reduce health inequalities.
  • Increased reporting duties

Care Act 2014

The Care Act 2014 states “Local authorities should, where possible, actively promote participation in providing interventions that are co-produced with individuals, families, friends, carers and the community.

"Co-production" is when an individual influences the support and services received, or when groups of people get together to influence the way that services are designed, commissioned and delivered.”

Co-production is also referred to at a number of points in the statutory guidance.
